An Ounce of Prevention

    Even good children can get arrested.  When an incident that may involve criminal activity occurs, depending on the circumstances and what the police officers are told, a child may be arrested even if he/she did nothing wrong. 

    Being arrested is a scary and traumatic experience for adults and children alike.  The stress of being arrested can impair a person’s judgment.  As such, it is important that your child know how to behave and what to do if he or she is arrested. 

    First, your child should treat the police and other law enforcement officials with courtesy and respect.  Despite the stressful circumstances, your child should try to remain calm.  Most importantly, your child should not waive his or her right to an attorney or right to remain silent.  Remaining silent can go a long way toward minimizing the legal consequences related to the arrest and any criminal charges filed.

    Make sure your child understands he/she should not talk about their case to anyone.  If your child calls you on the telephone, you should tell your child not to discuss the arrest with you over the telephone.  Anyone who overhears the telephone conversation can become a trial witness if your child is charged with a crime.
